Any time the ownership of land changes, a Transfer smart form must be filed with Teranet Manitoba to update the names on the title. This applies when the title is being transferred to a family member (such as a spouse, parent, child, or sibling) or by a third party.

 

Key Points

Listing Transferees (Buyers): All transfers of land must list as transferees all the people who will own the land after the transfer is registered, even if they are already on the title.

Signatures Required: All owners listed on the title must sign the transfer form, even if they will remain owners after the transfer is registered. Transfer form must be witnessed by a practicing lawyer.

Fees and Taxes: Upon registration of a transfer of land, a registration fee and possibly a land transfer tax must be paid.

Note: Unless the person you are seeking to remove has passed away, a Transfer form must be completed and submitted to Teranet Manitoba.
