There are many variables and complexities that could arise with consolidating/splitting land. There also may be legal requirements that must be met so that your land rights and ownership are protected. Therefore, seeking advice from a professional such as a Manitoba practicing lawyer or a Manitoba Land Surveyor will be helpful in preparing your request.
When consolidating or splitting land, you may encounter and will need a professional for:
- Encumbrances on the property,
- Registering a plan,
- Planning approval for your proposed, and/or
- Tax implications incurred when consolidating or splitting of the land.
We advise that if you haven’t already done so your first step is to reach out to the Planning Office for your district. If you're in Winnipeg, that would be the City of Winnipeg Planning office, and if you're outside of Winnipeg, it would be your local municipality. They’ll be able to guide you on the process and what you’ll need.
The Government of Manitoba Municipal and Northern Relations Department website is a helpful resource to get you started, and has produced a guide called Subdivision in Manitoba (attached to this email) that outlines the steps to subdividing property in MB. This guide is very comprehensive and will be very helpful for someone who has not been through the process before.
Once you have sought planning approval and completed the necessary steps, you can then register your request by filling out the Request/Transmission Form available on our website and paying the registration fee upon submission to complete the consolidation/or split with our office.
