What can I do if a certificate of judgment is filed against my title?

A certificate of judgment (“judgment”) certifies that the court has issued a judgment for a monetary amount against you. The party who the judgment is in favour of (“judgment creditor”) has registered it at Land Titles to place a lien against your land or land you have an interest in.  

 

If a judgment has been registered against your land, we encourage you to order a copy and review it with a trusted legal advisor to discuss your options. 

 

Options you may consider:

1. Ask for a discharge: If the judgment has been registered in error, you can ask the judgment creditor to discharge it. To remove the judgment, a Discharge form must be registered by the judgment creditor. If the judgment creditor won’t do so, you may be able to remove it with a 30-Day Notice.

 

2. Apply for a 30-Day Notice: You can apply for a 30-Day Notice at Land Titles, which notifies the judgment creditor that you’re challenging its validity. Once notified, the judgment creditor has 30 days to start a legal proceeding against you. If a Pending Litigation Order isn’t filed at Land Titles within 30 days, we’ll remove the judgment upon your submission of a written request. 

 

The request must contain a satisfactory explanation as to why you believe the judgment is invalid. You can’t request a 30-Day Notice if you think that the court has made an error in issuing the judgment against you, or if you’re seeking spousal or child support, as these matters must be addressed by the court.
